The terms and conditions contained herein and those described on the Company’s website (to be read in combination and referred to herein in their entirety as “The Agreement”) shall be binding for each and every customer of Cash for Gold Mailer.

Definitions. The terms “you”, “your”, and “customer” refer to the person(s) or entity offering an item(s) for purchase and/or sending any item(s) containing precious metals (gold, platinum, silver, or any combination thereof), jewelry, gemstones, other personal ornaments, or any combination thereof (collectively hereinafter referred to as “Merchandise”) to Company for sale and purchase, as well as accessing or using our websites and providing us with your personal information (collectively hereinafter referred to as “Transaction”). “We”, “our”, and “us” refer to Company (through any of its divisions) and its employees, agents, members, owners, directors, officers, successors and assigns. You agree to the terms and conditions set forth herein, by using our services, sending us your Merchandise, or by signature, whether electronic or in writing.

Description of Your Merchandise. You agree to accurately list and describe the Merchandise that you send to us on the packing list, which you will send back to us along with your Merchandise. You can print the packing list from our website or you may obtain one from us in an Cash for Gold Mailer sent to you by mail or e-mail.

Paypal and Direct Deposit Payments
If upon approving the payout amount, you choose to be paid via direct deposit or PayPal, the 30-day money-back guarantee is waived. As soon as you approve the payout offer, you will be paid and the items will be sent to our refinery for melting.

Requirements for Use
Every customer must be at least eighteen (18) years of age. Every customer of Cash for Gold Mailer must be the legal owner of any and all gold, jewelry, and other property sold or attempted to be sold. Every customer must be acting on his or her own behalf and not as the agent or representative of another person. Guarantee Against Loss
Cash for Gold Mailer will guarantee against loss of the total contents properly shipped in accordance with the instructions and procedures established by Cash for Gold Mailer and subject to the terms and conditions herein. Cash for Gold Mailer reserves the right, in its sole discretion, to reject delivery of any mail, envelope or package which appears to be damaged, opened, or tampered with and any such mail, envelope or package will be returned to the customer. Cash for Gold Mailer shall have no liability to any customer for any such attempted delivery or return of any such items.

Insurance Coverage Requirements
In order for an insurance claim to be valid, proof of value and purchase is required, such as an original purchase receipt.

Limitation of Liability
This limitation of liability shall be binding on each and every customer and any third party, including but not limited to, the customer and the customer’s successors, assigners, insurance carriers and any other individual or entity asserting any right or claim relating to customer’s transaction with Cash for Gold Mailer. In no event shall Cash for Gold Mailer be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence, except as stated herein. In no event shall Cash for Gold Mailer be liable to any third party, including any insurance carrier. Cash for Gold Mailer shall not be liable for any subrogation claim brought by the customer’s insurance carrier. By submitting an item to Cash for Gold Mailer, the customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

Cash for Gold Mailer’s liability is and shall be expressly and specifically limited to the LEAST of the following sums:

The liquidation value placed on the total contents by Cash for Gold Mailer in Cash for Gold Mailer’s sole discretion.

One-third (1/3) of the appraised value of the contents according to an appraisal submitted by a customer/seller to Cash for Gold Mailer, which appraisal was issued prior to the shipment of the item to Cash for gold Mailer; and, the sum of two thousand ($2,000.00) US dollars.

The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents begin submitted to Cash for Gold Mailer, Cash for Gold Mailer’s liquidated value shall be conclusive and binding and further, that in no event shall Cash for Gold Mailer’s Liability exceed two thousand ($2,000.00) US Dollars.

Cash for Gold Mailer shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above. By submitting the items, customer explicitly and expressly accepts this limitation of liability.

If you believe your gold jewelry or other property is worth more than $2,000.00, please call customer support, and ask for an increase in insurance. We also strongly advise that you list the contents of your mailer on the enclosed packing list, which you must return to us.

Verbal Offers
Any customer or prospective seller may request Cash for Gold Mailer to provide a telephone or e-mail quote for his or her items after such items have arrived at Cash for Gold Mailer’s processing facility. Verbal offers may, at the discretion of Cash for Gold Mailer, be recorded. Upon a verbal acceptance by the customer on the telephone, e-mail quote, or via the online payment management system, payment will be issued by Cash for Gold Mailer within twenty four (24) hours of such acceptance, and the thirty (30) day customer satisfaction holding period guaranty will no longer be applicable to such transaction.

Offer Acceptance or Rejection
After our determination of the amount of our Offer for your Merchandise, we will, in our sole discretion, notify you by either sending you (A) an email with a link to your account on our website,; (B) an email, text, or chat message; or (C) provide an offer via telephone, each of which will give you the opportunity to accept or reject our offer.

Gold Chart Disclaimer of Liability
Cash for Gold Mailer shall not be responsible for the contents or accuracy of any gold chart data appearing on its website. These charts are prepared by third parties, and Cash for Gold Mailer includes such charts only for general information to its customers. Cash for Gold Mailer shall not be liable to anyone who relies on the information contained therein.

Return Insurance Liabilities
If an item is returned to a customer, Cash for Gold Mailer will insure the item for no more than the amount offered by Cash for Gold Mailer regardless of what it was insured for when mailed by the customer to Cash for Gold Mailer, unless Cash for Gold Mailer is otherwise notified by e-mail or fax by the customer prior to the return shipment and the customer agrees to pay for any extra insurance requested. Cash for Gold Mailer shall, in its sole discretion, choose the return carrier, insurance and receipt verification method for each transaction.

Electronic Communication and Signature
You consent to receive communications electronically from Cash for Gold Mailer. If you have provided us an e-mail address, you agree that any notices required by the Electronic Funds Transfer Act, Regulation E and/or any other provision of applicable federal or state law may be delivered electronically, to the extent permitted by law. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. You agree that by clicking on or selecting a button or icon on our website, relating to any agreement, acknowledgment, consent, terms, disclosures or these terms and conditions, such selection constitutes your signature, acceptance and agreement as if actually signed by you in writing. Choice of Law, Waiver, and Claims
The Agreement shall be governed by the laws of the State of New York without regard to its conflict of law provisions. Cash for Gold Mailer’s failure to exercise or enforce any right or provision of the Agreement will not be deemed to be a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Cash for Gold Mailer must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in the State of New York. Cash for Gold Mailer shall be entitled to reimbursement for any and all costs incurred by it in defending any civil action filed or attempted to be filed in any jurisdiction outside of the State of New York, including but not limited to, attorney’s fees incurred by Cash for Gold Mailer.

Indemnification
The customer agrees to and will indemnify, defend and hold us harmless from and against any and all claims, lawsuits, investigations, disputes, controversies, judgments, liabilities, obligations and damages relating to or arising out of any (A) Transactions with Cash for Gold Mailer, (B) any noncompliance with these Terms and Conditions, or (C) the title to, ownership of or lien on any Merchandise offered for sale, sold or purported or arranged to be sold by you to us.

Waiting Period For A Claim
A customer who wishes to submit a claim to Cash for Gold Mailer must NOTIFY THE COMPANY IMMEDIATELY TO REQUEST A CLAIM FORM. In order to be processed, the claim form must be fully and accurately completed, signed and mailed to Cash for Gold Mailer in accordance with the claim form instructions. The customer must submit any and all supporting documentation with the completed and signed claim form. Failure to properly complete, sign and/or mail the claim form WITH PROOF THAT THE GOODS WERE MAILED TO Cash for Gold Mailer will result in the denial of the claim by Cash for Gold Mailer. There is a 30 day waiting period from the time the claim form is received by Cash for Gold Mailer and the claim is processed.
